Terms of Service
These terms cover two things: the AllOutMaine app at alloutmaine.com, where people find and host pickup sports, and the AllOutMaine shop at shop.alloutmaine.com. Using either one means you agree to them. They're written in plain English on purpose — if something here is unclear, email us and we'll explain it, not hide behind it.

1. Who can use AllOutMaine
You must be 18 or older to create an account, join or host a game, or buy from the shop. Anyone can browse the public court directory and game listings. If we learn an account belongs to someone under 18, we'll close it.
2. What AllOutMaine is — and isn't
AllOutMaine is a free community tool for finding people to play with. It is run by one person in the Greater Bangor area, not a company with a staff.
- We are not a booking service. AllOutMaine is not affiliated with any court, park, school, club, or facility. Posting or joining a game does not reserve a court or guarantee it is open, lit, dry, or available. Public courts are first-come, first-served.
- We don't vet players. Anyone 18 or older can make an account. We don't run background checks, verify identities, or check anyone's skill level. Use the same judgment you'd use meeting anyone new.
- Hosts aren't us. People who post games are other players, not employees, agents, or representatives of AllOutMaine. What they say, do, or promise is on them.
- Court information is best-effort. Hours, surfaces, lighting, nets, and whether a venue exists at all come from public sources and from players, and can be out of date. Check before you drive.
3. Playing at your own risk
Pickup sports are physical. People get hurt playing basketball, pickleball, tennis, soccer, and everything else on the app — sprains, falls, collisions, worse — and they get hurt on public courts with cracks, wet leaves, and bad lighting. By using AllOutMaine to find or host a game, you accept that risk yourself.
Specifically, to the fullest extent Maine law allows, you agree that AllOutMaine and the person who runs it are not responsible for any injury, illness, death, property damage, theft, or loss arising from a game or activity you found, joined, or hosted through the app, from the condition of any venue, or from the conduct of any other player — and you release us from any claim about them. You are responsible for deciding whether you're fit to play, for your own equipment, and for knowing your limits.
If you host a game, you're also responsible for following the venue's posted rules, hours, and permit requirements. We don't obtain permits on anyone's behalf.
4. Your account
- Give us accurate information, and keep your email current — it's how we reach you about games you're in.
- Your account is yours alone. Don't share it, and don't make one for someone else.
- Keep your password and any sign-in code to yourself. If you choose "stay signed in," anyone with your unlocked phone can act as you; that's a trade-off you're making.
- Tell us right away if you think someone else has used your account.
5. Code of conduct
The short version you agreed to at sign-up still applies: be good to each other. In more detail, you agree not to:
- Harass, threaten, demean, or discriminate against anyone — on the app or at a game — on any basis, including race, ethnicity, religion, sex, gender identity, sexual orientation, age, disability, or skill level.
- Post a game you don't intend to hold, or join one you don't intend to attend, without dropping out so your spot opens up.
- Add "guests" who aren't real people, or use guest spots to hold a game you're planning to fill another way.
- Post anything false, misleading, obscene, or unlawful, or anything you don't have the right to post.
- Use the app to sell things, advertise, recruit, or spam other players. (Organizations get a specific, limited version of this — see section 8.)
- Scrape, copy, or bulk-download the directory or other players' information, or use automated tools against the app.
- Try to break in, probe, or overload the app, or interfere with anyone else's use of it.
We can remove content, cancel games, or close accounts for breaking these rules — including for behavior at a game that's reported to us — at our discretion and without notice. We don't owe anyone an appeal, though we'll usually explain.
6. What you post
You own what you post — game listings, comments, notes, your profile photo, links to your social accounts. By posting it you give AllOutMaine a non-exclusive, royalty-free, worldwide licence to store, display, and share it as needed to run the app (showing your game to other players, for instance, or your name and photo on a roster). That licence ends when you delete the content or your account, except where it's already been shared in a way we can't take back — a game reminder that's already been emailed, say.
Some of what you post is public by design. Game listings, host names, venue check-ins, and public comments can be seen by other users and, in some cases, by anyone. Your game history and the notes you write in it are private to you. See the Privacy Policy for the full picture.
You're responsible for what you post. Don't post anyone else's personal information, and don't post photos of people who haven't agreed to it.
7. Hosting and joining games
- A game listing is an invitation, not a contract. Hosts can change or cancel; players can drop out. We ask everyone to do it early enough that others can adjust, and the app tells the roster when something changes.
- Games are free. A host may note a real, shared cost — a court fee split between players, for example — but AllOutMaine takes no part in it, collects nothing, and isn't responsible for it.
- Check-ins, streaks, badges, and stats are for fun. They can be wrong, they can be reset, and they carry no value outside the app.
- We may remove a listing at any time, for any reason, including if a venue asks us to.
8. Organizations, leagues and tournaments
Clubs, businesses, and community groups can run an organization account and use it to post games, leagues, and tournaments. If you administer one:
- You confirm you're authorized to act for that organization, and it's bound by these terms through you.
- Anything the organization charges — league fees, tournament entries, memberships — is between the organization and the player. AllOutMaine doesn't collect it, hold it, refund it, or guarantee it, and an organization's own terms govern those payments. Where a league links to the organization's terms, those apply alongside these.
- Organization posts must be about actual games, leagues, and tournaments. An organization account isn't a licence to advertise unrelated things to players.
- You're responsible for the organization's conduct on the app, including its administrators' posts and its handling of players' information it gets through sign-ups.
Joining a league or tournament through AllOutMaine means the organization running it gets your name and contact details for that purpose. Once it has them, its own privacy practices apply.
9. Giveaways
From time to time we run giveaways — a hat, say — where entries come from playing: hosting or joining games during a stated window. No purchase is ever necessary, and buying from the shop never improves your odds. Each giveaway's own rules (window, how entries are earned, how the winner is picked, who's eligible) are posted with it and are part of these terms while it runs. Winners are chosen at random unless the rules say otherwise, are contacted by email, and have a reasonable time to claim. Prizes can't be exchanged for cash. We can end or change a giveaway if something goes wrong with it — fraud, a bug, a supply problem — and we'll say so.
10. Emails and notifications
We'll send you emails or phone alerts about things you're part of: a game you joined moved, someone commented on your game, your sign-in code. Those are part of running the service and continue while you have an account, though you can choose which channel they come through in Settings.
Separately, if you opted in to "news, tips, and community highlights" — in the app, or by ticking the box at the shop's checkout — we may send occasional marketing email. Every one has an unsubscribe link, and the setting is in your profile. Opting out of marketing never turns off the game alerts you asked for, and buying from the shop never opts you in. How consent works in detail is in the Privacy Policy.
11. The shop
shop.alloutmaine.com sells AllOutMaine merchandise. This section, together with How ordering works — which is part of these terms — sets out how that works.
Buying
- Prices are in US dollars and are what's shown at the time you order. We can change prices at any time, but not for an order you've already placed.
- Sales tax is calculated and added at checkout where it applies. Shipping is shown at checkout before you pay.
- Your order is an offer to buy; it's accepted when we send the confirmation email. In the rare case we can't fulfil it — a blank discontinued, a pricing mistake — we'll tell you and refund you in full.
- Discount codes are single-use per order, can't be combined, can't be applied after an order is placed, and may be limited, changed, or withdrawn at any time. A code that was never publicly advertised isn't an offer.
- Payments are processed by Stripe through Hostinger's checkout. We never see or store your card number.
Made to order
- Everything is printed or embroidered to order in Maine, in one batch each month. Timelines, shipping, sizing, cancellations, and what to do if something arrives wrong are all set out on How ordering works, and those rules are binding on both of us.
- Because items are made to order, we don't accept returns or exchanges for change of mind or size. Items that arrive damaged, misprinted, or not as ordered are replaced or refunded.
- Product images are mockups. Final garment shades and print colors can differ a little from a screen.
Not donations
AllOutMaine is not a registered nonprofit. Shop purchases are ordinary purchases, not donations, and are not tax-deductible. What's left after costs goes toward keeping the app free — but you're buying a shirt, and that's the whole of the transaction.
12. Our stuff and yours
The AllOutMaine name, logo, the "AOM" mark, the app, its design, and the court directory are ours. You can use the app for its intended purpose, and you can share links to it freely. You can't copy the directory, reuse the logo, or present yourself as AllOutMaine without asking. Buying a shirt with the logo on it lets you wear the shirt; it doesn't license the logo.
Map tiles are provided by CARTO and OpenStreetMap contributors under their own licences.
13. Services we rely on
AllOutMaine runs on other people's infrastructure — our web host, Hostinger's ecommerce platform and checkout, Stripe, Google Analytics, and CARTO / OpenStreetMap for the map. Their terms and privacy policies govern your interactions with them, and we're not responsible for their outages or actions. If one of them changes or goes away, a feature of ours may too.
14. Ending things
You can delete your account any time by emailing us. We can suspend or close an account for breaking these terms, for a long period of inactivity, or if we shut the service down. If we close your account for a rule violation, you shouldn't create a new one. Sections 3, 6, 12, 15, 16, and 17 survive the end of your account.
15. No warranties
AllOutMaine is provided "as is" and "as available." We're a small volunteer-run project and we don't promise it will be available, error-free, or secure, that game listings will be accurate, that a court will be open, or that other players will show up or behave. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. Nothing in this section limits the specific promises made about shop orders in section 11, or any warranty the law says can't be disclaimed.
16. Limits on our liability
To the fullest extent Maine law allows, AllOutMaine and the person who runs it are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the app or the shop — however caused, and even if we were told it might happen. Our total liability to you for anything arising from the app is limited to $100; for anything arising from a shop order, to the amount you paid for that order.
Some states don't allow some of these limits. Where that's the case, they apply only as far as the law permits. Nothing here limits liability for our own fraud or for anything that can't be limited by law.
You agree to cover us — including reasonable legal costs — for claims by third parties that arise from what you post, from a game you host, or from your breaking these terms.
17. Maine law, and disputes
These terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules. If we have a dispute, please email first — most things can be sorted out in a couple of messages. If not, disputes will be brought in the state or federal courts located in Penobscot County, Maine, and you agree to that venue. If any part of these terms is found unenforceable, the rest still applies.
18. Changes to these terms
We may update these terms as the app grows. When we do, we'll update the date at the top and, for anything material, say so in the app's What's New. Continuing to use AllOutMaine or the shop after a change means you accept it. The version in force is always the one at this address.
